Pound Ridge Planning Board Gives Early Nod To Oceanus

POUND RIDGE, N.Y.  -- The town Planning Board has given a preliminary subdivision approval needed for Oceanus Navigation Corp.’s development project.

The Oceanus proposal, which is called a cluster subdivision, involves splitting a 105.68-acre site currently composed of two lots into 15 lots. Twelve of the lots would be residential, two would be for conversation and one would be a stormwater parcel, according to the proposal. The conservation parcels would be about half of the site, according to Joshua Kimerling, an attorney representing Oceanus.

The site is at High Ridge Road and Rolling Meadow Lane.

The approval, which was at the Planning Board’s April 22 meeting, passed 6-0. Judy Kennedy was the only member who was absent.

Oceanus has a history with the Planning Board that goes back to 2010, according to records, when its first informal meeting was held. The application was denied on April 12, 2012, according to a timeline included with the agenda. A lawsuit was filed against the Planning Board in response, according to the applicant's attorney. There is a tentative settlement between the parties, Kimerling confirmed.

Oceanus will need a final subdivision approval next. A return to the Planning Board is expected in a couple of months, according to a person who represented Oceanus.

Before giving the main approval, the Planning Board approved lowering the recreational fee amount connected with the buildable lots from $120,000 to $95,000 due to the inclusion in the project of a public trail. That space will be about an acre and a quarter. The vote in favor of lowering the amount passed 5-1 after two earlier votes involving reductions to $100,000 and then $90,000 failed because they ended in 3-3 splits.
