Roe said he will be trying to suppress evidence against Michael C. Brady, 36, who authorities said stabbed 40-year-old Tammy Pitts-Gaddy to death and suffocated young Natasha with a plastic bag because she saw the attack.
There is no cellphone evidence, the lawyer said, adding that he wanted to know if a report on those would be produced.
Assistant Bergen County Prosecutor Danielle Grootenboer said there is a report from one of her investigators but that she also plans to consult engineers from a cellphone provider.
“I don’t think we should be doing any hearing before the end of the calendar year,” she said.
Guida scheduled the next hearing for Nov. 16.

Family members confronted Brady after not being able to reach Pitts-Gaddy — and he, in turn, went with them to her Englewood apartment, Bergen County Prosecutor John L. Molinelli said following his arrest.
When he got there, Brady “acted as if he discovered the bodies when he entered through the window,” the prosecutor said.
The 6-foot-1-inch, 210-pound Brady — a citizen of Jamaica who has been in the U.S. since he was 10 — Brady worked for Pritchard Industries and was assigned as a custodian at the Leonia Middle School.
He’d been dating Pitts-Gaddy for three years, living on and off with her and her daughter when he wasn’t staying with his parents in Teaneck, Molinelli said.
Brady stabbed Pitts-Gaddy in her home the morning of Jan. 28, 2013, he said.
“It is believed the child witnessed the altercation and stabbing, and that Brady smothered her to death by holding a plastic bag over her head,” the prosecutor said. “He then fled the residence.”
Brady remain held on $2 million bail in the Bergen County Jail.
