Pound Ridge Police Charge Driver Under Leandra’s Law

POUND RIDGE, N.Y. – Juan Zuluaga of Bedford was taken into police custody Friday evening and charged with DWI under Leandra’s Law, police said.

Zuluaga, 40, was driving erratically along Long Ridge Road with three small children and an adult passenger in the car, police said. Officer Greg Walz of the Pound Ridge Police stopped the vehicle, noticed several open alcoholic beverage containers inside, interviewed the driver and ultimately administered field sobriety tests, police said.

?Failing to pass the tests, Zuluaga was taken into custody, police said. Further investigation revealed that when police stopped the car, Zuluaga’s adult passenger, Miranda Delfino of Trumbull, Conn., had taken an open beer bottle from his hand and attempted to hide it on the floor, police said.

Delfino was charged with multiple misdemeanor counts of endangering the welfare of a child.

Both were arraigned and released on their own recognizance with orders to appear in Pound Ridge Justice Court on April 29.

Leandra’s Law, a child protection act, automatically turns a first-offense DWI conviction, ordinarily a misdemeanor, into a felony if the driver with a blood alcohol content of 0.08 is convicted of driving drunk with a person age 15 or under in the vehicle. The bill was unanimously passed in 2009 by New York State lawmakers after Leandra Rosado, 11, was killed and six other children were injured in a DWI auto accident on the Henry Hudson Parkway.
