Long Island Man Found Drunk, Passed Out In Scarsdale Driveway, Police Say

SCARSDALE, N.Y. – A Long Island man was arrested in Scarsdale on Sunday after police say he was found passed out in his car in a Post Road driveway with the driver’s side door wide open.

Shortly after midnight on Sunday, Scarsdale police were alerted to a “suspicious vehicle” that was parked in a driveway on Post Road when the homeowner stated that “somebody is sleeping off something or is passed out with the driver side door open in (her) driveway, please send someone” to dispatchers.

When police responded to the Post Road residence, they found North Baldwin resident Ryan McPherson, 33, asleep in the driver’s seat, with the keys of his 2002 Acura in the ignition. When reporting officers woke him, McPherson asked, “where am I?”

McPherson required assistance to exit his vehicle, as he was “disoriented and unsteady on his feet,” according to the police report. “While speaking with (McPherson), officers observed his speech to be slow and slurred,” with “a strong odor of alcohol emanating from his breath as he spoke.” He was observed to be “wavering between excited and erratic.”

According to the report, McPherson said he had been drinking in Yonkers and the Bronx, and when prompted by police about why he was parked in the Scarsdale driveway, he stated, “I wanted to sleep it off.”

An Alco Sensor test – which required several attempts to successfully complete as McPherson resisted – revealed the presence of alcohol in his system. He refused to submit to a Datamaster test on two occasions while in police custody, and ultimately was found to have a blood alcohol content of .17 percent, more than twice the legal limit, when he backed down.

McPherson was eventually charged with misdemeanor counts of driving while intoxicated and operating a motor vehicle with a blood alcohol content of more than .08 percent. He was released on his own recognizance and is due back in Scarsdale Village Court on Wednesday, Aug. 5.
